 China is drafting a law that would allow the establishment of special psychiatric institutions under the jurisdiction¹ of law enforcement authorities, to take care of mentally ill offenders².

我国正在起草一部法律，该法将允许建立由执法机关管辖的专门的精神病机构，收治肇事肇祸精神病人。

The draft regulation, published by the State Council last Wednesday to solicit³ opinions from the public, says that facilities should be managed and supervised in the same way as other police detention⁴ centers.

国务院上周三公布了这份条例送审稿，向社会公开征求意见。送审稿规定，强制医疗所应推行与其他公安监所一样的监管模式。

Under China's Criminal Law, offenders deemed not criminally responsible due to mental illness may be exempted⁵ from criminal penalties but should receive medical treatment supervised by his or her guardians⁶. If necessary, the government will force them to be institutionalized.

根据中国的刑法，因精神疾病而被视为不负刑事责任的罪犯可免除刑事处罚，但是应在其监护人的监督下接受药物治疗。必要时由政府强制医疗。

In practice, however, institutionalization is loosely enforced due to lack of facilities and detailed⁷ protocols⁸. Mentally ill offenders are sometimes sent to normal psychiatric hospitals.

然而在实际中，由于缺乏相应的医疗所和细则，制度化的执行是很不严格的。精神病罪犯只有个别的会被送往正规的精神病院治疗。

The draft regulation clarifies the responsibilities and power of psychiatric detention facilities.

该条例草案明确了精神拘留机构的责任和权力。

The facilities are allowed to place patients under confinement⁹ or use constraints¹⁰ when they may harm themselves or other people, according to the draft.

根据该草案，对于可能实施伤害自身、危害他人安全行为的被强制医疗人员，强制医疗所可以采取隔离、约束等措施。

They are banned from forcing patients to work or conducting surgeries on them.

强制医疗所不得强迫被强制医疗人员从事生产劳动，严禁对其实施外科手术。

Patients will be reviewed within 30 days after the first-year term at the facilities and reviewed again every six months. If they are considered stable and harmless, the facilities will apply to the court for releasing or transferring them, according to the draft.

强制医疗执行期满1年之日后的30日内，被强制医疗人员将被诊断评估，此后每隔半年进行一次诊断评估。如果其病情稳定、已不具有人身危险性，强制医疗所将向法院申请将其释放或移交。
