Cambodian Prime Minister Hun Sen has 1)blasted the United Nations for what he 2)perceives as U.N. interference in preparations for a Khmer Rouge war crimes 3)tribunal. The prime minister says Cambodia will hold 4)genocide trials for former Khmer Rouge leaders, with or without U.N. participation. The comments are the latest in a running 5)dispute between the United Nations and Cambodia over what shape a tribunal should take.
Cambodian Prime Minister Hun Sen Friday accused the U.N. leadership of trying to 6)dictate the terms of a Khmer Rouge tribunal. In scathing language, the 7)outspoken Cambodian leader said his government would hold Khmer Rouge trials on its own if necessary, and 8)bluntly told the United Nations to stay out of Cambodian affairs.
Mr. Hun Sen's anger was sparked by a statement issued by U.N. Secretary-General Kofi Annan. Through a spokesman Mr. Annan said no trials can start until Cambodia signs and 9)ratifies an informal 10)memorandum of understanding between Cambodia and the United Nations, and that any Cambodian law on the tribunal must conform to that memorandum. The memorandum was 11)thrashed out after nearly a year of negotiation, but Cambodia has yet to sign it.
Mr. Hun Sen called the secretary-general's statement "12)idiotic" and said it violates Cambodia's rights and 13)sovereignty. He said once Cambodia's Parliament passes a final version of a draft law on the tribunal, no further changes will be made to accommodate U.N. concerns.
Nearly two million Cambodians are believed to have died under the Maoist-inspired Khmer Rouge, which ruled Cambodia from 1975 to 1979. After years of 14)turmoil in the intervening years, Cambodia now has a measure of political stability, which has led to heightened calls for an international tribunal to try the remaining Khmer Rouge leaders for crimes against 15)humanity.
But the issue, while clear-cut to the outside world, is 16)controversial in Cambodia. Many former Khmer Rouge members have re-entered society, and some even hold senior positions in government. There are those, Mr. Hun Sen among them, who have warned that putting Khmer Rouge leaders on trial could open old wounds and re-17)ignite civil war. Some critics have charged Mr. Hun Sen and his government with stalling on the issue.
The government's proposal for an all-Cambodian tribunal was met with 18)skepticism abroad because of concerns about the competence of Cambodia's still-embryonic judicial system. The United Nations has offered its assistance to set up the panel, but on the condition that any trial must meet international standards of justice.
The draft law under consideration by the Cambodian 19)Parliament now calls for a mixed tribunal of Cambodian judges and international jurists. A U.N. Human Rights 20)envoy, Peter Leuprecht, said in Phnom Penh Thursday the proposal, while 21)flawed, is better than nothing.
The draft law is now before the 22)National Assembly. Once passed there, it must be sent to the Senate for approval and then to King Norodom Sihanouk for his ratification.
